Acceptable Use PolicyWe respect each Subscriber's privacy at TwinCitizenSM Online (TCO). However, as a Subscriber, you are fully responsible for the privacy of, content of and liability for your own communications. The following general rules apply to our users.
Subscriber/User Obligations
All TCO Subscribers and their constituents, who have access to TCO and to the networks of other providers, shall comply with the TCO Acceptable Use Policy and the acceptable use policies governing those networks. It is the responsibility of all Subscribers and others who have access to TCO to:
All users are expected to use good judgment. A flexible, friendly atmosphere can be maintained if every Subscriber uses the service with care. As the Subscriber, you are responsible for actions taken by your account and are required to follow all applicable laws and statutes.
- Use TCO facilities, services or resources in a manner which does not violate any applicable laws or regulations;
- Respect the privacy of other users, and to not intentionally seek information on, obtain copies of or modify files, other data or passwords belonging to other users without permission;
- Respect the legal protection provided by copyright, trademark, licenses and other laws to programs, data and documents. You may not upload to TCO any data or software that is subject to distribution or copyright limits. You have the sole liability for any data or software uploaded to TCO;
- Minimize un-authenticated or anonymous access accounts and the transmission or distribution of messages or articles from those accounts;
- Use TCO facilities, services or resources in a manner that does not interfere with or disrupt other network users, services or equipment. Such interference or disruption includes, but is not limited to: wide-scale distribution of messages to inappropriate forums or mailing lists, propagation of computer worms or viruses, use of the network to make unauthorized entry to other computational, information or communications devices or resources. This includes unauthorized security probing activities or other attempts to evaluate the security integrity of a network or host system without permission.
We Are Not a Content Provider
We exercise no control over the content or the information passing through TCO. The persons and organizations, including TCO Subscribers, who publish materials and information that are accessible through TCO are solely responsible for the content of such materials and information and are solely responsible to know and to comply with all laws applicable to the publication of such materials and information. TCO is not responsible for the content of the materials and information published by others that are accessible through the TCO networks and is not responsible for the violation of any laws resulting from such publication.
With the exception of information specifically authored by or on behalf of TCO, TCO does not develop or publish, nor does TCO review, censor or edit the materials and information which are accessible through TCO, or the materials and information which are accessible through the other computer networks which may be connected to TCO.
Publishing of profane or pornographic words or images on Web pages in user areas provided is prohibited. TCO reserves the right to remove such postings at its discretion.
We will take immediate action against any TCO Subscriber who abuses any TCO facilities, services or resources. We will rely on the complaints from any of the following: other users on the TCO system, users on other hosts on the Internet, and any other information we may receive. TCO will review all complaints or instances of inappropriate utilization of facilities, services or resources. TCO will decide at its sole discretion what action is to be taken, including the termination of account services. If you have any complaints about another Subscriber's utilization of TCO's services or facilities please contact us at once.
Use of Your Account
By using TCO facilities, services or resources, Subscriber is indicating acceptance to the terms and conditions set forth in this document. All Subscribers must include a home or business mailing address. All subscribers must be of legal age (at least 18) and may be required to provide proof of age. As a Subscriber, you may not resell this service or access to this service in any way unless prior arrangement has been made in writing.
As a Subscriber you may have an additional Authorized Representative who is vested with the same authorities as the Subscriber. This agreement must be signed in the legal name of the Subscriber and (if you choose to have one) the legal name of the Authorized Representative. Your account may be used by yourself, members of your immediate family or an Authorized Representative of your company.
Your service may be terminated if your account is used by someone other than yourself, immediate family member or an Authorized Representative of your company. Additional user ID's are not transferable and are to be used only in the household of the master account holder. Sharing of password or account information to any other persons is forbidden. The Subscriber is responsible for all actions stemming from the account, unless it is proved that unauthorized intrusion resulted in such actions. Concurrent logins of the same account are not permitted. Unattended use of your account (line camping) is strictly prohibited. Processes run by your account must be run interactively. Unattended processes will be terminated. Mass mailings, flaming, spamming, mail bombing, using bots, malicious pinging, unverifiable return headers or any attempt to flood the system or impede the use or function of the system will not be tolerated. Violations may result in disconnection.
Subscriptions are for Personal Accounts only. Subscriptions cover base rates only. All hours over the base rate will be billed at the current full rate for your account type. Charges for hours over the base rate will be billed the month after service and are due upon receipt. If the Subscriber's rate plan grants the use of FTP space, only the master ID (original ID) may be used for storage or hosting. Any data found in the additional accounts will be deleted without notice.
Privacy
TCO is strongly committed to protecting the privacy of Subscribers and desires to contribute to providing a safe and secure environment for consumers. For your protection, TCO will never release information about you to other parties unless required to do so by the appropriate authorities.
In general, TCO automatically gathers certain usage information like the number and frequency of visitors to TCO and other websites, very much like television ratings that tell the networks how many people tuned in to a program. TCO only uses such data in the aggregate. This collective data helps TCO determine how much Subscribers use parts of our site as well as others, so they can improve it to assure that it is as appealing as TCO can make it for as many of you as possible.
As you know, to serve you we need certain kinds of information. For example, when you sign up, we require certain information such as name, Internet address, billing address, type of computer, credit card number and phone number in order to provide basic services to you. TCO may, in the future, ask you whether you are interested in information about additional products and services. However, you will have the choice to request that information or say you are not interested, before receiving any such information.
Account Suspension and Cancellation
Unless under contractual obligation, TCO Subscribers have the right to cancel their accounts at any time, for any reason.
TCO reserves the right to suspend and/or cancel any TCO account in accordance with the provisions of this Acceptable Use Policy or for any reason not prohibited by law.
If your account is suspended or interrupted, you are not relieved of the obligation to pay the monthly account charges. Only a written notice to cancel this agreement relieves you of future charges. If you send us written notice via E-Mail, we will contact you or your authorized representative by phone to confirm you decision to cancel this agreement. If you cancel this agreement, payments for pre-paid months beyond the current month shall be refunded unless you are under contractual obligation for those payments.
Billing
TCO will bill, under authorization of the Subscriber, the Subscriber's credit card beginning on the day of account activation and once per month thereafter that the user is subscribed to the service. All accounts are billed monthly, in advance along with any overtime charges from the previous month and applicable taxes. Should TCO be unsuccessful in receiving payment via Subscriber's authorized credit card, the account will be considered past due and Subscriber's account access will be terminated until other payment arrangements can be made. The Subscriber is still liable for any and all charges incurred until the time of disconnection and any collection/legal fees incurred in the collection of the debt. A setup fee may be charged for account reactivation.
Billing for the use of the service shall be continued at the chosen Plan of the Subscriber until such time as the Subscriber changes the Plan or cancels the service.
Advance payment plans are non-refundable and non-transferable.
This agreement is strictly confidential and is not transferable or assignable without prior written consent of TCO.
Enforcement and Violations
Each TCO Subscriber shall be responsible to distribute, publicize and enforce the TCO Acceptable Use Policy at their sites. In addition, each TCO Subscriber shall provide this policy to appropriate administrative authorities at all sites connected to theirs via connections not directly supported by TCO.
If TCO becomes aware that a TCO Subscriber is in violation of the law or this Acceptable Use Policy, TCO reserves the right to impose disciplinary action up to and including, the expulsion of the Subscriber from TCO, termination of TCO services, and forfeiture of all fees paid to date. Evidence of illegal or prohibited activities may be disclosed to law enforcement authorities.
TCO services are provided on an as available basis and TCO makes no warranties of any kind, whether expressed or implied in connection with the products or services provided hereunder. TWIN CITIZEN ONLINE INTERNET SERVICES SPECIFICALLY DISCLAIM ANY WARRANTY OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PURPOSE. Neither TCO nor TCO officers, employees, directors, agents or staff shall be responsible for any liability or damages you suffer or others may suffer, which arise out of or relate in any way to this Agreement or your use of other's use of services provided hereunder. This includes, but is not limited to, any liability for lost profits, loss of opportunity, loss of data, or any other loss including that which may result from any use, misuse, delay, non-deliveries, mis-deliveries, service interruptions, negligence, errors or omissions, deletion of files or E-Mail, loss of or damage to data, defects, viruses, or any failure of performance, whether or not limited to acts of God, communication failure, theft, destruction or unauthorized access to TCO records, programs or services. You hereby acknowledge that this provision will apply whether or not TCO is given notice of the possibility of such damages and that this provision will apply to all content, merchandise or services available from TCO or its affiliates. The terms of this section shall survive any termination of this agreement. Use of any information obtained via TCO's network is at your owns risk. TCO specifically denies any responsibility for the accuracy or quality of information obtained through our services.
Modifications to this policy
TCO reserves the right to modify this policy at any time. Subscribers will receive prompt notification of all modifications.
